Complaints Procedure - PAVES color magic s.r.o.

General provisions
These Complaints Procedure governs the procedure of PAVES color magic, s.r.o. registered office: Nádražní 378, 667 01, Židlochovice, Czech Republic, IČO: 29318203, DIČ: CZ29318203 registered at the Regional Court in Brno, file no. 77401, Section C, (hereinafter referred to as "Seller") and Buyer (hereinafter referred to as "Buyer") in exercising the rights arising from the Seller's liability for defects in goods purchased atwww.combs-brushes.com and the rights and obligations of Buyer and Seller therefrom related.

Procedure of the Buyer who is a consumer within the meaning of § 419 et seq. of Act No. 89/2012 Coll. Civil Code, as amended, in exercising the rights arising from the liability of the Seller for defects of goods purchased at www.combs-brushes.com and as a modification of the rights and obligations of the Parties related thereto shall be governed by the provisions of Section 1810 et seq. of Act No. 89/2012 Coll. Civil Code, as amended and Act No. 634/1992 Coll., on Consumer Protection, as amended.

Procedure of the Buyer who is not a consumer within the meaning of § 419 of Act No. 89/2012 Coll. Civil Code, as amended, in exercising the rights arising from the liability of the Seller for defects of goods purchased at www.combs-brushes.com, as well as the adjustment of the rights and obligations of the Contracting Parties related thereto are governed by § 2079 et seq. of Act No. 89/2012 Coll., the Civil Code, as amended, and the Claims Conditions below do not apply to him.

By sending an electronic order to the Seller, the Buyer confirms that he has read the Seller's Complaints Procedure and agrees with it without reservation. The moment the electronic order is sent to the Seller, the Complaints Procedure becomes binding on the Buyer.

The Complaints Procedure is publicly available at combs-brushes.com and at the Seller's registered office.

Article II

Inspection of goods at takeover
Upon receipt of the goods, the Buyer is obliged to check whether the packaging in which the goods are packaged is not damaged. In case of damage, it is necessary to write a protocol on the place of delivery of the goods with the carrier - courier about the detected defects caused during transport. If the Buyer accepts the goods with damaged packaging, the Seller will not accept any later claim for this reason.

The buyer is obliged to inspect the delivered goods without undue delay after its receipt. The Buyer finds out the incompleteness of the goods or any damage of the goods caused by the transport, which does not show the external damage of the packaging, it is obliged to lodge a complaint immediately, but no later than two days after receiving the shipment from the Seller. If the Buyer fails to do so, the delivery shall be deemed complete and without defects;

The Buyer is obliged to complain to the Seller for defects of goods purchased at www.combs-brushes.com without undue delay according to the conditions specified in the relevant provisions of Act No. 89/2012 Coll., The Civil Code, as amended.

Article III

Withdrawal from the Contract / Complaints Procedure
The Buyer is obliged to complete the Withdrawal from the Contract / Complaint Form (hereinafter the “Form”) in all cases:

1.1 Withdrawal from the contract within 14 days

The Buyer has the right to withdraw from the Purchase Contract within 14 days of receipt of the goods without giving any reason. The goods returned by the Buyer must be undamaged and must not show any signs of wear and use. In this case, the Buyer shall not pay the handling fee in connection with the withdrawal from the Purchase Agreement.

In the event of withdrawal from the contract, the Buyer shall bear the costs of returning the goods.

1.2 The Buyer requires replacement of the goods due to unsatisfactory parameters of the goods

In the event that the Buyer finds that the goods ordered by him does not suit him, he has the right to return the goods and request their replacement for goods of a different size, color, up to 14 days from the receipt of the goods by the Buyer. The goods can be exchanged only if the goods are in stock of the Seller. Otherwise, the Buyer shall be deemed to have withdrawn from the Purchase Agreement and shall proceed in accordance with Section 1.1 hereof.

1.3. The buyer claims from defects of the goods

2. The Buyer shall provide the following information in the form:

2.1 Identification of the Buyer, ie business name or surname, seat / domicile, contact (telephone and email address);
2.2. Address of the place where the goods were delivered;
2.3. Address to which the replaced goods are to be delivered, in the case of replacement;
2.4 Electronic order number;
2.5 Date of issuing the electronic order;
2.6 The date of receipt of the goods by the Buyer;
2.7 Description of the goods that the Buyer requests to be replaced and a description of the replaced goods, indicating the code, color, size, quantity, price and method of packaging the goods.
2.8 Name and number of Buyer's bank account and name and code of the bank where the account is maintained;
2.9 Date and signature of Buyer.

If the Form is not fully completed or if the Document is not attached to the Form (hereinafter referred to as the “Required Documents”), the Seller shall ask the Buyer by telephone or electronically to complete the missing data or to submit the missing Required Documents.

If, together with the completed Form and the Required Documents, the goods subject to the exchange / complaint are not enclosed, the Seller reserves the right not to proceed with the matter in question, provided that the Buyer does not intend to / replace / claim the goods. If the Buyer fails to send the goods within 14 days from the date of receipt, the

Goods that are subject to a return / replacement / claim must be complete, unused, undamaged and in their original packaging. The Buyer bears the risk of damage to the goods that are the subject of the return / replacement / complaint until the moment of receipt of the goods by the Seller.

The Buyer is obliged to send the completed Form together with the Required Documents and the goods that are the subject of the return / exchange / claim by registered mail to the address of the Seller's registered office. The Seller reserves the right not to accept the goods sent by the Buyer cash on delivery.

The total price for the goods returned to the Seller in accordance with these GTC shall be transferred to the Buyer's account specified in the Form within 14 days of receipt of the completed Form together with the Required Documents and goods returned for the reason specified in 1.1, 1.2. and 1.3 hereof.
